一、编制背景

　　I. Legislative Background

　　为积极做好我市国际航行船舶保税油加注业务管理工作，市商务局在前期试点基础上，编制了《深圳市国际航行船舶保税油经营管理办法》（以下简称《管理办法》），作为今后开展保税油加注业务管理的操作依据。

　　The Commerce Bureau of Shenzhen Municipality, based on the pilot program outcomes, has formulated the Measures of Shenzhen for Administration of Bonded Oil Operations for Vessels Engaged on International Voyages (the Measures) as the basis for the management of bonded oil bunkering business, to effectively manage bonded oil bunkering for vessels engaged on international voyages.

　　II. Legislative Rationale

　　开展国际航行船舶保税油加注业务需要解决一些主要问题：一是缺乏成熟完善的制度来规范国际航行船舶保税油经营业务；二是涉及的部门多、环节多，协调难度大。

　　Some major issues remain unsolved regarding bonded oil bunkering for vessels engaged on international voyages: First, there is a lack of a robust system to regulate the bonded oil business for vessels engaged on international voyages. Second, coordination in the regulatory process is difficult due to the involvement of many departments and procedures.

　　针对以上问题，我市总结前期试点经验并参考兄弟城市的做法，对经营资格管理、规范经营、监督管理等要求逐一明确。

　　To address these issues, the city set out the requirements concerning business qualification management, standardized operations, supervision, and management by summing up the pilot program outcomes and drawing upon other cities' practices.

　　三、主要内容

　　III. Main Contents

　　《管理办法》主要涉及保税油经营企业的从业准入、退出、日常监管等内容，分为五章二十七条，包括：总则、经营资格管理、经营规范、监督管理、附则等五大部分。主要内容如下：

　　The Measures cover the access, exit, and routine supervision of bonded oil businesses, consisting of 27 articles under five chapters, including General Provisions, Operation Qualification Management, Operation Rules, Supervisory Management, and Supplementary Provisions. The main contents are as follows:

　　一是明确管理机制。《管理办法》明确由深圳市人民政府对保税油经营资质实行统一管理，总量控制，有序推动。属地区政府（含大鹏新区、深汕特别合作区管委会）、市商务局、市交通运输局、深圳海关、深圳海事局、深圳边检总站、市发展改革委、市公安局、市财政局、市规划和自然资源局、市海洋发展局、市生态环境局、市应急管理局、深圳市消防救援局、市国资委、市市场监管局、市地方金融管理局、市口岸办、深圳市税务局、国家金融监督管理总局深圳监管局、人民银行深圳市分行（国家外汇管理局深圳市分局）、深圳海警局、广东海警局直属分局等单位按照各自行政管理职责做好保税油经营监督管理工作。

　　First, specifying the management mechanism. The People's Government of Shenzhen Municipality shall exercise unified management over bonded oil operation qualifications, control the total quantity, and promote orderly business development. District governments (including the Administrative Committees of Dapeng New District and Shenshan Special Cooperation Zone), the Commerce Bureau of Shenzhen, Transport Bureau of Shenzhen, Shenzhen Customs, Shenzhen Maritime Safety Administration, Shenzhen Exit-Entry Border Checkpoint, Development and Reform Commission of Shenzhen, Public Security Bureau of Shenzhen, Finance Bureau of Shenzhen, Planning and Natural Resources Bureau of Shenzhen, Marine Development Bureau of Shenzhen, Ecology and Environment Bureau of Shenzhen, Emergency Management Bureau of Shenzhen, Fire and Rescue Bureau of Shenzhen, State-owned Assets Supervision and Administration Commission of the People's Government of Shenzhen Municipality, Market Regulation Bureau of Shenzhen, Local Financial Regulatory Bureau of Shenzhen, Office of Port of Entry and Exit of the People's Government of Shenzhen Municipality, Shenzhen Municipal Office of the State Administration of Taxation, Shenzhen Municipal Office of the National Financial Regulatory Administration, Bank of China Shenzhen Branch (Shenzhen Office of State Administration of Foreign Exchange), Shenzhen Coast Guard, and direct branches of Guangdong Coast Guard shall supervise and administer bonded oil operations according to their administrative responsibilities.

　　二是明确准入条件和申报程序。《管理办法》明确国际航行船舶保税油经营资格申请条件以及需要提交的材料、业务申请流程、审查及审批流程等。明确批准证书续期及信息变更等办理程序和审批流程。

　　Second, setting out access criteria and application procedures. The Measures set out the criteria for applying for the qualification for bonded oil operations for vessels engaged on international voyages, the documents required, the application procedures, the review and approval procedures, as well as the application and approval procedures for approval certificate renewal and information change.

　　三是明确规范经营。《管理办法》对企业规范经营提出了具体要求，明确了保税油经营企业应建立管理台账，完善质量、安全、环境保护管理制度，依法经营，禁止发生“超越批准证书范围经营”等12类行为。

　　Third, setting out regulated operation requirements. The Measures set out specific requirements to regulate companies' operations, stating that bonded oil operation enterprises shall establish management registers, improve quality, safety and environmental management rules, operate according to the law, and must not commit 12 types of acts including "operate beyond the business scope in the approval certificate".

　　四是明确监督管理制度。《管理办法》明确了属地区政府（含大鹏新区、深汕特别合作区管委会）对保税油经营行为实行的监督管理制度，包括具体承担保税油经营业务的事中事后政府管理与服务等统筹协调工作，对企业实行年度经营活动监督检查。明确了保税油经营企业停歇业、终止经营、违法违规等情形的处理办法。

　　Fourth, specifying the supervision and management mechanism. The Measures specify the mechanism under which district governments (including Administrative Committees of Dapeng New District and Shenshan Special Cooperation Zone) supervise and administer bonded oil operations, including the overall coordination of in-process and ex-post government management and services regarding bonded oil business, and the annual supervision and inspection of companies' operational activities. The rules are also set forth for dealing with bonded oil operation companies' suspension of business, termination of operation, and violations of laws and regulations.
